Terms of Service

Effective Date: February 12, 2026

1. Agreement to these Terms

These Terms of Service (“Terms”) are a binding agreement between you and MedTract LLC d/b/a 4Core Functional Health (“4Core,” “we,” “us,” or “our”). They govern your use of the 4Core website, client portal, mobile and web applications, and related services, including connected device and remote monitoring features (together, the “Services”).

By creating an account, connecting a device, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. About 4Core and the Services

4Core provides functional health assessments, personalized care plans, and related wellness and clinical services. Clinical services are delivered by licensed nurse practitioners and other providers under physician oversight.

The Services may include:

  • Online scheduling, intake forms, and assessments

  • Access to your care plan, results, and reports through the client portal

  • Optional connection of wearable devices so your 4Core care team can review your health data between visits

3. Medical Disclaimer — Not for Emergencies

If you think you are having a medical emergency, call 911 or go to the nearest emergency room immediately.

  • No real-time monitoring. Data from connected devices is not monitored continuously or in real time. Your care team reviews it periodically, and there may be delays between when data is recorded and when it is reviewed.

  • Device data may be inaccurate. Wearable devices are consumer products. Their measurements may be incomplete, delayed, or inaccurate, and they are not a substitute for clinical testing or examination.

  • Not a substitute for your care team. Information in the platform, including reports, scores, and educational content, is not a diagnosis on its own. Do not start, stop, or change any medication or treatment based on the Services without talking to a qualified provider.

  • Your responsibility. Contact your 4Core provider or your primary care physician with questions about your health, and seek in-person care when symptoms warrant it.

4. Eligibility and Your Account

  • You must be at least 18 years old to create an account.

  • You agree to provide accurate, current information and to keep it up to date.

  • You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at provider@4core.ai if you believe your account has been accessed without permission.

  • Accounts are personal. Do not share your account or use someone else’s.

5. Connected Devices and Wearables

You may choose to connect a wearable device or health app, such as Oura, WHOOP, Withings, or Garmin, to your 4Core account.

  • Optional and with your permission. Connecting a device is voluntary. You authorize the connection through the device maker’s own sign-in and consent screen, and you choose which data types to share.

  • What we collect. Depending on your device and the permissions you grant, this may include sleep, readiness or recovery, activity, heart rate, heart rate variability, blood oxygen, and workout data.

  • How we use it. Your 4Core care team uses this data only to support your care: reviewing trends, tracking progress, and informing follow-up between visits. We do not sell your device data.

  • Disconnecting. You can disconnect a device at any time from your account settings or from the device maker’s app. Disconnecting stops new data from being shared; data already received becomes part of your health record and is kept as described in our Privacy Policy and as required by law.

  • Device maker’s terms. Your device and its app are provided by the device maker and governed by its own terms and privacy policy. Some devices require an active subscription with the maker (for example, an Oura Membership) for data sharing to work. We are not responsible for a device maker’s products, outages, or changes to its data access.

  • No fee for connecting. We do not charge for connecting a device.

6. Privacy and Health Information

Our Privacy Policy explains how we collect, use, store, and protect your information, and it is part of these Terms.

By using the Services, you consent to receiving communications from us electronically, including by email, text message, and in-app notifications. You can opt out of marketing messages at any time; we may still send messages related to your care and account.

7. Fees and Payment

4Core services are self-pay. We do not bill insurance or provide superbills. Fees for assessments, visits, programs, and other services are disclosed before you purchase them.

  • Payment is due as stated at the time of purchase. You authorize us to charge your selected payment method for the services you purchase.

  • Cancellation, rescheduling, and refund terms are disclosed at the time of purchase.

  • Connecting a wearable device is free and is not a paid feature.

8. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms

  • Access or attempt to access another person’s account or data

  • Copy, modify, reverse engineer, or create derivative works of the Services, except as allowed by law

  • Interfere with or disrupt the Services, or introduce malware or harmful code

  • Use automated tools to scrape or collect data from the Services

  • Submit false or misleading health or identity information

9. Intellectual Property

The Services, including the software, assessments, reports, care plan formats, educational content, and the 4Core name and logos, are owned by 4Core or its licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Services for your own care. Your personal health information remains yours.

10. Third-Party Services

The Services may link to or work with third-party products and services, such as wearable devices, labs, pharmacies, supplement suppliers, and payment processors. Those services are governed by their own terms. We are not responsible for third-party services, and your use of them is at your own risk.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted or error-free, or that data from connected devices will be accurate, complete, or timely. Nothing in this section limits any professional duty your licensed providers owe you under applicable law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, 4CORE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR PROFESSIONAL NEGLIGENCE.

13. Indemnification

You agree to defend, indemnify, and hold harmless 4Core and its affiliates, officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Services or your violation of these Terms.

14. Termination

You may stop using the Services and close your account at any time by contacting provider@4core.ai. We may suspend or end your access if you violate these Terms or if required by law. Ending your account does not delete health records we are legally required to keep. Sections that by their nature should survive termination (including 3, 9, 11, 12, 13, and 15) will survive.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to their jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services before they take effect. Continuing to use the Services after the effective date means you accept the updated Terms.

17. General

These Terms, together with the Privacy Policy and any consent or financial agreements you sign with 4Core, are the entire agreement between you and 4Core about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
